Part A

Terms & Conditions of Website Use & Sales

1) Acceptance of these Terms

By accessing showthyme.co.nz (the “Site”) or placing an order, you agree to these Terms. If you don’t agree, please don’t use the Site.

We may update these Terms from time to time. The “Last updated” date shows when changes were made. Your continued use means you accept any updates.

NZ law still applies: Nothing here limits your rights under the Consumer Guarantees Act 1993 (CGA) and Fair Trading Act 1986 where they apply.

2) Using the Site (what’s okay and what’s not)

Use the Site lawfully and respectfully. Don’t:

  • Break the law; infringe IP or privacy rights.
  • Scrape, crawl, or frame the Site without permission.
  • Upload malware, spam, or offensive/defamatory content.
  • Try to access accounts or data that aren’t yours, or bypass security.
  • Use bots/scripts to place orders or harvest data.

We may suspend/terminate access for breaches.

3) Accounts

Keep your login secure and up to date. You’re responsible for activity under your account. Tell us promptly if you suspect unauthorized access. We may close accounts that are inactive, fraudulent, or in breach of these Terms.

4) Product information, pricing & GST

  • We aim for accurate product details, images, colours, pricing, and stock, but errors can occur.
  • Prices are in NZD and include GST unless otherwise stated.
  • We may correct errors or update info at any time. If we discover a pricing/stock error after you order, we’ll contact you to confirm, modify, or cancel with a refund.

5) Orders, payment & shipping

  • Orders are offers to buy; we accept when we dispatch and send confirmation.
  • We use trusted payment providers; your card is charged at checkout.
  • Shipping options, timeframes, and fees are shown at checkout and in your order email.
  • Risk & title: Title passes on full payment; risk passes on delivery to your address.

6) Promotions, gift cards & bundles

Promos/discount codes have specific terms (eligibility, dates, limits). Unless stated, they can’t be combined and don’t apply to gift cards, clearance, or already-discounted items. We may modify or withdraw promotions at any time.

7) Intellectual property & linking

All Site content (text, images, graphics, product data, design, code) is owned by us or our licensors. You get a personal, non-commercial, revocable licence to view the Site. Don’t copy, adapt, sell, or reuse content without written permission. You may link to public pages in a fair and legal way that doesn’t suggest endorsement.

8) Reviews and other content you submit

If you submit reviews, photos, questions, or other content (“User Content”):

  • You warrant you own it and it’s accurate and lawful.
  • You grant us a worldwide, royalty-free, perpetual licence to use, edit, reproduce, display, and share it (including for marketing).
  • We may remove or edit User Content that breaches these Terms or the law.

9) Warranties, disclaimers & liability (site use)

The Site is provided “as is” and “as available.” We don’t guarantee it will be uninterrupted, error-free, or virus-free.

To the maximum extent permitted by NZ law:

  • We exclude all warranties not expressly stated here.
  • We’re not liable for indirect or consequential loss, loss of profits, data, or business interruption arising from Site use.
  • For any liability that can’t be excluded relating to Site use, our total aggregate liability is NZD $100.

Business purchases: If you acquire goods for business purposes, you agree the CGA does not apply (as permitted by section 43(2) CGA). For goods not of a kind ordinarily acquired for personal, domestic, or household use, our liability is limited to the remedies set out in the CGA.

10) Third-party sites & services

We link to external sites and use third-party tools (e.g., payment gateways, analytics). They’re not under our control. Check their terms and privacy policies; you use them at your own risk.

11) Governing law

These Terms are governed by New Zealand law. You submit to the non-exclusive jurisdiction of New Zealand courts.

 

Part B

Privacy Policy (Privacy Act 2020)

1) What this policy covers

How we collect, use, share, and protect personal information about visitors, customers, and account holders in New Zealand.

Your rights: Under the Privacy Act 2020, you can access and request correction of your personal information.

2) What we collect

  • Contact & identity: name, email, phone, addresses.
  • Order details: items purchased, payments (via our payment partners), delivery info.
  • Account info: login, preferences, saved addresses.
  • Marketing preferences: email opt-ins, unsubscribes, campaign engagement.
  • Technical data: IP address, device/browser, pages viewed, cookies (see Cookies).
  • User Content: reviews, questions, support messages.
  • Optional: photos for reviews, special delivery notes.

We generally collect information from you. We may also receive limited data from service providers (e.g., payment status from our gateway, analytics from our website tools).

3) Why we use it (purposes)

  • To provide the Site & services: process orders, take payment, deliver goods, handle support.
  • To improve & personalise: diagnose issues, analyse traffic, improve navigation, show relevant products.
  • To communicate: order updates, service messages, responses to queries.
  • To market (with consent where required): newsletters, offers, product updates (you can opt out anytime).
  • To comply with law & prevent misuse: fraud prevention, record-keeping, responding to lawful requests.

4) Cookies & analytics

We use cookies and similar technologies to:

  • Keep you signed in and remember preferences.
  • Measure performance (e.g., which pages are popular).
  • Support advertising/retargeting on third-party platforms (if used).

You can control cookies in your browser; blocking some cookies may affect Site functionality. If we use a consent banner, your choices there will apply.

5) Payment processing

Payments are handled by third-party payment gateways. We don’t store your full card details on our servers. The gateway processes your payment securely and gives us a transaction status.

6) Sharing your information

We share personal information only as needed to run the business, including with:

  • Operational partners: couriers/shipping, warehouses (if any).
  • Payment providers (to process payments and prevent fraud).
  • IT & analytics providers that host our Site and help us understand usage.
  • Professional advisers (accountants, legal).
  • Regulators or law enforcement when legally required, or to enforce our Terms.

We don’t sell personal information.

7) International transfers

Some providers may store/process data in other countries. Where we use them, we take reasonable steps to ensure they have appropriate safeguards in place.

8) Retention

We keep personal information only as long as needed for the purposes above or to meet legal/record-keeping requirements, and then delete or anonymise it.

9) Security

We use reasonable technical and organisational measures to protect personal information (e.g., access controls, encryption in transit where applicable). No method is 100% secure; please keep your account login safe.

10) Your privacy choices & rights

  • Access & correction: Email help@azzaro.gnomie.co.nz to request a copy of your information or ask us to correct it.
  • Marketing: You can unsubscribe using the link in our emails or by emailing us. We comply with the Unsolicited Electronic Messages Act 2007.
  • Cookies: Adjust your browser settings or use our cookie controls (if available).

If you’re not satisfied with our response, you can contact the Office of the Privacy Commissioner (NZ).

11) Children

Our Site and products are aimed at adults. We don’t knowingly collect personal information from children. If you think a child has provided information, contact us and we’ll take appropriate steps.

12) Changes to this policy

We may update this Privacy Policy from time to time. The “Last updated” date applies. Significant changes will be highlighted on this page.

How this interacts with our Returns Policy

For returns, refunds, and exchanges, please see our Returns & Refunds Policy (separate page). If there’s any conflict, the Returns Policy governs returns; these Terms govern Site use and sales; the Privacy Policy governs personal information.
